1. Agreement to Terms
By accessing and using Summit Active Co.'s website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. Summit Active Co. provides adventure tourism services including mountain expeditions, wilderness hiking tours, and photography workshops throughout Canada.
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity, and Summit Active Co., concerning your access to and use of our services. You agree that by accessing our services, you have read, understood, and agreed to be bound by all of these Terms of Service.
2. Adventure Services and Activities
Summit Active Co. provides outdoor adventure services including but not limited to mountain climbing expeditions, wilderness hiking tours, photography workshops, and guided nature experiences. All activities are conducted in natural outdoor environments and carry inherent risks associated with outdoor recreation and adventure tourism.
Participants acknowledge that outdoor adventure activities involve risks of injury, illness, or death, and may include exposure to severe weather conditions, difficult terrain, wild animals, and other natural hazards. By participating in our services, you voluntarily assume these risks and agree that Summit Active Co. shall not be liable for any injuries or damages that may occur during your participation.
All participants must meet minimum fitness requirements and follow safety guidelines as provided by our certified guides. We reserve the right to refuse service or terminate participation if safety requirements are not met or if participants fail to follow instructions from our guides.
3. Booking and Payment Terms
Reservations for all adventure programs must be made in advance through our website or authorized booking agents. Full payment is required at the time of booking unless otherwise specified. All prices are listed in Canadian dollars and include applicable taxes unless otherwise noted.
Cancellations made 30 days or more before the scheduled departure date will receive a full refund minus a $100 CAD processing fee. Cancellations made 15-29 days before departure will receive a 50% refund. Cancellations made less than 15 days before departure are non-refundable. Weather-related cancellations initiated by Summit Active Co. will receive full refunds or credit toward future bookings.
We reserve the right to cancel any trip due to insufficient enrollment, weather conditions, or other circumstances beyond our control. In such cases, participants will receive a full refund or credit toward alternative dates.
4. Health and Fitness Requirements
All participants must be in good physical health and capable of participating in strenuous outdoor activities. Participants with medical conditions, injuries, or physical limitations must disclose these conditions at the time of booking and may be required to provide medical clearance from a physician.
Participants are required to complete a health questionnaire and liability waiver before participating in any activities. False or incomplete information regarding health status may result in immediate termination of participation without refund.
Minimum age requirements vary by activity. Children under 16 must be accompanied by a parent or guardian. Some activities have minimum age requirements of 18 years or older due to the technical nature and risk level involved.
5. Equipment and Personal Property
Summit Active Co. provides specialized safety equipment including helmets, harnesses, ropes, and other technical gear as required for specific activities. Participants are responsible for personal clothing and equipment as specified in pre-trip materials.
All equipment provided by Summit Active Co. must be used according to manufacturer specifications and guide instructions. Participants who damage or lose provided equipment may be charged replacement costs.
Summit Active Co. is not responsible for loss, theft, or damage to personal property during trips. We recommend participants carry appropriate travel insurance to cover personal belongings and equipment.
6. Photography and Media Release
During trips and activities, Summit Active Co. staff may take photographs or video recordings for promotional, educational, and marketing purposes. By participating in our services, you grant Summit Active Co. the right to use your likeness in photographs, videos, and other media without compensation.
If you do not wish to be photographed or recorded, please notify your guide at the beginning of the activity. We will make reasonable efforts to exclude you from group photos and videos while still documenting the overall experience.
7. Guide Authority and Safety
All Summit Active Co. guides are certified professionals with extensive training in outdoor leadership, wilderness first aid, and risk management. During all activities, the guide's decisions regarding safety, route selection, and group management are final and must be followed by all participants.
Guides have the authority to modify itineraries, change routes, or terminate activities based on weather conditions, group ability, safety concerns, or other factors. Participants who fail to follow guide instructions or engage in unsafe behavior may be removed from the group without refund.
In emergency situations, guides are authorized to make decisions regarding medical treatment, evacuation, and emergency response on behalf of participants who are unable to make such decisions themselves.
8. Limitation of Liability
Summit Active Co., its employees, guides, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our services or participation in our activities, regardless of the theory of liability.
Our maximum liability for any claim shall not exceed the amount paid by the participant for the specific service or activity giving rise to the claim. This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential damages, so the above limitations may not apply to you in those jurisdictions.
9. Privacy and Data Protection
We are committed to protecting your privacy and personal information. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated by reference into these Terms of Service.
We collect personal information necessary to provide our services, including contact information, health information, emergency contacts, and payment information. This information is used solely for the purpose of providing our services and ensuring participant safety.
10. Governing Law and Dispute Resolution
These Terms of Service and any disputes arising under them shall be governed by the laws of British Columbia, Canada, without regard to conflict of law provisions. Any legal action or proceeding arising under these terms shall be brought exclusively in the provincial or federal courts located in British Columbia.
Before pursuing formal legal action, we encourage participants to contact us directly to resolve any disputes or concerns. We are committed to working with our clients to address issues in a fair and reasonable manner.
11. Changes to Terms
Summit Active Co. reserves the right to modify these Terms of Service at any time. Updated terms will be posted on our website and will take effect immediately upon posting. Your continued use of our services after posting of revised terms constitutes your acceptance of such changes.
We will make reasonable efforts to notify existing clients of significant changes to our terms, but it is your responsibility to review these terms periodically for updates.
